TERMS & CONDITIONS

By submitting payment, the client acknowledges and agrees to these Terms & Conditions.

(Applies to actor headshots, branding sessions, business portraits, commercial work, unit stills, and all creative services.)

1. Definitions

• Images / Reels – Any photographs, videos, social clips, BTS, or visual media created by Josh during your session.

• Reproduction – Any use, posting, printing, copying, uploading, distribution, or publication of Images/Reels.

• Client – The person or organization booking and paying for the session.

• Shoot / Session – The date, time, and service booked with Josh.

• Deposit – Non-refundable amount required to secure the booking.

• Session Fee – The full cost of the shoot + included retouched images.

• Additional Image Fees – Fees for extra edits, express edits, reels, licensing, or upgrades.

• Licensing – The specific usage rights granted for commercial or business use outside of personal/actor promotion.

2. Copyright & Ownership

• Josh retains full copyright to all Images/Reels created — worldwide and in perpetuity.

• The Client is purchasing a license to use the images, not ownership of the files.

• RAW or unedited files are never released, under any circumstance.

• No altering, AI editing, filters, or third-party retouching is permitted unless approved in writing.

• Josh may use Images for his own portfolio, website, social media, marketing, industry promotion, and in print unless otherwise agreed in writing.

3. Usage Rights

Personal / Actor Self-Promotion

Included automatically for actor headshots, branding, and portraits:

• Casting profiles (Actors Access, Backstage, Casting Networks, etc.)

• Social media (Instagram, LinkedIn, Facebook, etc.)

• Personal website + digital portfolios

• Agent/manager submissions

Please Credit artists work, it is always appreciated.

Commercial / Business / Advertising Use

NOT included unless purchased separately.

Any of the following require licensing:

• Paid advertising

• Print marketing

• Billboards or signage

• Product promotion or endorsements

• Business branding, website headers, email marketing

• Company-wide or multi-property use (Airbnb, real estate, law firms, etc.)

Commercial, Business Booster, Corporate, Buyout, and Annual Licensing fees apply as outlined on the website.

Unauthorized commercial use will be billed at min 2× the standard licensing rate per image.

4. Booking, Deposits & Rescheduling

• A 50% non-refundable deposit is required to secure your session.

• The remaining balance is due 72 hours before your shoot unless otherwise noted.

• Dates and times are not held without a deposit.

Rescheduling

• Rescheduling made 14+ days before your session transfers your deposit once with a doctor’s note or approved emergency.

• Rescheduling anytime automatically requires a new deposit.

• Only one reschedule allowed per booking without a doctor’s note or approved emergency.

• Work conflicts, callbacks, auditions, travel, “something came up,” etc. do not qualify for free reschedules.

Cancellations

• Client cancellations at any time = deposit forfeited.

• If the Client does not show, the session is marked as cancelled.

• If Josh must cancel or postpone, the deposit is transferred to new date.

5. Payment Policies

• All invoices must be paid by the stated deadline.

• No services, galleries, downloads, or edits will be released until invoices are paid in full.

• Late payments may incur fees or suspension of gallery access.

• No refunds, credits, or chargebacks are offered for any reason.

• Express editing, extra images, and licensing fees must be paid before delivery.

6. Delivery of Images

• Josh selects the strongest Images from your session based on his expertise.

• Only retouched images are delivered — no RAWs or unedited files.

• Standard turnaround is 2–3 weeks unless express services are purchased.

• Galleries remain live for 30 days.

• Re-sending or re-opening galleries after expiration requires a resend fee and after 6 months an archival fee.

• Images are archived for 6 months; after that, retrieval is not guaranteed.

For commercial clients, delivery timelines are specified per invoice or contract.

7. Retouching & Re-Edits

• Retouching is included only for the number of images outlined in your package.

• Additional edits may be purchased at the listed rate.

• Retouch notes are accepted but final artistic decisions remain at Josh’s discretion.

• Retouching requests must be submitted within 1 month of your shoot.

8. Liability

• Josh and team are not responsible for:

• missed callbacks or bookings

• scheduling conflicts

• personal dissatisfaction due to styling, posing, expressions, weather, or self-perception

• third-party misuse of images

• If Images are lost or corrupted before delivery, liability is limited to a complimentary re-shoot.

• Client agrees to indemnify Josh for any unauthorized use or breach of licensing terms.

9. General Terms

• These Terms & Conditions, along with the invoice, form the entire agreement.

• Policies may be updated on www.joshstringer.com at any time.

• Continued use of Images constitutes acceptance of the current Terms.

• Georgia law governs all agreements unless otherwise stated (for LA, travel, and/or commercial contracts.)

• No refunds under any circumstance.
